IRS Notice CP2566 – Missing Form 1040

IRS Notice CP2566 is sent to taxpayers who failed to file a Form 1040 tax return for a specified year or multiple years.

Why Did I Receive IRS Notice CP2566?

You received notice CP2566 because you did not file Form 1040 for the specified year(s) and were sent several notices asking you to file a return. Due to your non-compliance, the IRS has completed a Substitute for Return (SFR) on your behalf and determined you owe taxes, as well as penalties and interest fees.

Next Steps

Review your IRS CP2566 carefully, paying close attention to the amount due and the deadline date provided. You must file your own Form 1040 by the deadline date, or the IRS will use its SFR, which does not include credits or deductions you may be eligible to claim. This may result in a higher tax balance than if you file on your own.

If you choose to file your own Form 1040:

  • Complete, sign, date, and return the Response form in your CP2566 and mail it along with a copy of your tax return. This must be received by the deadline date provided in the notice/letter.

If you don’t think you’re required to file:

  • Call the IRS at 866-681-4271 to speak with a representative and explain why you believe you are not required to file.

If you choose to accept the proposed SFR amount:

  • Complete, sign, and date the Response form and mail it to the address provided along with the total amount due (including penalties and interest) by the deadline date to avoid additional fees.
  • If you can’t pay the amount in full, send what you can and set up a payment plan for the remaining balance.

You must contact the IRS by the deadline date, or it will move forward with collection actions. This not only includes additional penalty and interest fees, but may also include wage garnishment, tax liens, or levies.
